(CNN) — The judge who will take over the case of a Florida man accused of shooting an unarmed teenager has high ratings from defense lawyers but isn’t known as a “soft touch,” one Florida attorney said Wednesday.
Seminole County Circuit Judge Kenneth Lester Jr. will start by presiding over a bond hearing for George Zimmerman on Friday. Lester was assigned the intensely scrutinized case Wednesday afternoon after the recusal of Judge Jessica Recksiedler, who had been asked to step aside by Zimmerman’s lawyer.
“He’s a great judge,” Orlando lawyer Diana Tennis told CNN sister network HLN. “He’s been on the bench a really long time. He’s very no-nonsense. He’s a real fast talker, very efficient, gets the cases in and out.”
Tennis said Lester is “not known as a soft touch” but has a reputation for listening to both sides of a case.

Homeowners might be on hook in civil action in Trayvon Martin’s death

The people who could end up paying the financial price for the shooting death of Trayvon Martin are, ultimately, the homeowners of the Retreat at Twin Lakes development in Sanford, experts say.
If their crime-watch program captain George Zimmerman gets charged with and convicted of killing Trayvon, the community’s homeowner association and property-management company will likely be sued by the victim’s family regarding the way the watch program was established and operated, said Donna Berger, a lawyer who specializes in homeowner-association law.
“They may wind up getting sued and getting hit with hundreds of thousands of dollars in legal fees and damages,” said Berger, who works with the South Florida law firm Katzman, Garfinkel and Berger. “Who will pay is every member of the association, and they will have to make special assessments. … It’s a cautionary tale for other associations.”

* Alan’s Comments - What worries me is that everyone is going to be afraid to “watch” any more … to have a neighborhood watch … to have a security service. And they will try to vote down self defense laws of all kinds, along with any concealed weapons laws. We will be a defenseless scared unable to move “lot” of people. Easy picking for any kind of crime. “Oh they won’t watch or follow anyone any more … and nobody has guns any more. Don’t worry about it take whatever you want. Do whatever you want to ‘em.” It was bad enough in the Trayvon Martin incident that almost nobody was outside, no one came outside when there were screams for help. Coulda, Woulda, Shoulda … If someone had stepped up to the fight and said “Hey, break it up” and stood there and insisted they STOP … instead of just telling them to stop and going back inside, the whole thing could have ended a whole lot better. Of course that might be dangerous, but school sports coach and other staff have to do that on a regular basis. Break up fights that is. Where have all the cowboys gone? (I feel a song coming on.)
The cell phone is already pretty much the only weapon carried in a holster. And many guys flash them like a badge in their cell phone holster. “Don’t try anything funny … I have a cell phone!” Maybe “9-1-1″ will be a special button labeled “(you wish you had self-) DEFENSE”. Mash the button … “9-1-1 do you need Police, Fire, Medical, or a Police Area Check on someone suspicious?”. You see the police could do an area check … they could follow someone suspicious. They could confront them and ask them “What are you doing around here”. And they would expect answers … or would take further action.
By the way … the whole “Skittles and Arizona Tea” just might have been MADE UP. “Unarmed little boy with only Skittles and Iced Tea can”. Well the police never found any Skittles and Arizona Iced Tea as has been portrayed by the media. (in other words your “7-11 visit for Skittles and Tea” reeks!) (from: Your Ghost Dog Story Reeks! — from the movie “Under Suspicion”.) According to what I read the attorneys for Trayvon’s Family gave that information to the media. So where did they get it? They didn’t find Skittles either? Supposedly the word “Tea” is street talk for Marijuana - and “Skittles” is also street talk for narcotic “Pills” (comes from a mixed bag of pills … Skittles.) So maybe they found a text message on Trayvons phone … or on some other paper or electronic communications trace that was left behind. But no Skittles … and no Tea at the crime scene. Maybe he left that at home and the family has it? It would be evidence. Maybe he left it around the property while walking around and looking about? Perhaps someone will find it later and turn it in. The spat between City Hall and the Port Authority over the design of a unified radio system for cops and firefighters at the new World Trade Center is costing taxpayers a cool $12 million, The Post has learned.
That’s because while the PA is building its own controversial radio system at the WTC — at a separate cost of $130 million to the bi-state agency — the city, rather than join in, is plunking down $12 million to unilaterally expand its own communications system at the site.
The city dough will come from money from federal counterterrorism grants already dispatched to Albany, sources said.

says that there is a financial motivation in this Trayvon Martin - Zimmerman case. They aren’t asking for a conviction … just that he be arrested. The web site indicates that the commodity may be worth little or nothing unless and arrest is made. The arrest requires a PC - Probably cause. And that arrest is all that is required for civil trial … no conviction is necessary. The commodity then becomes potentially valuable. I’m not saying that Trayvon Martin is a commodity to be traded, in my opinion, his death is tragic and I wish for justice in the case, I’m just telling what I’m reading on the above cited web site.

This is allegedly Trayvon and others in a Fight Club like scene near his school in Miami, Florida. I read elsewhere that Trayvon regularly refereed for these street fighting sessions. (So they practiced fighting?) But *they* claim that Trayvon was not the aggressor in the Trayvon - Zimmerman incident (and case).

SANFORD, Fla. (AP) — George Zimmerman has been arrested and is being charged with second-degree murder for the fatal shooting of Trayvon Martin on Feb. 26.
Special prosecutor Angela Corey announced the charge at a news conference Wednesday, seven weeks after the homicide took place.
Trayvon Martin’s parents, civil rights leaders and other people have portrayed the case as racially charged, saying Zimmerman would have been arrested immediately had he been black and the victim white. Martin was black.
The case has raised a multitude of questions, some of which remain unanswered.
Q: WHY DID IT TAKE SO LONG FOR ZIMMERMAN TO BE ARRESTED?
A: Special prosecutor Angela Corey says that probable cause had to be determined before authorities could arrest Zimmerman. She said there was only a slight delay, when she took it over from the previous prosecutor, who recused himself from the case.
Zimmerman told police he acted in self-defense after Martin pursued and attacked him. Florida is among 21 states with a “stand your ground law,” which gives people wide latitude to use deadly force rather than retreat during a fight. The Florida law lets police on the scene decide whether they believe the self-defense claim.
In many cases, the officers make an arrest and leave it to the courts to work out whether the deadly force is justified. In this case, however, police have said they are confident they did the right thing by not charging Zimmerman.

A: Martin, 17, was shot and killed by a single gunshot wound to the chest Feb. 26 during a confrontation with Zimmerman, a 28-year-old neighborhood watch volunteer in a gated community of townhomes in Sanford, Fla., about 20 miles northeast of Orlando.
Zimmerman was driving through the neighborhood when he spotted Martin, who was unarmed and walking to the home of his father’s fiancee. She lived in the same gated community as Zimmerman.
Martin was returning from a trip to the convenience store with an iced tea and a bag of Skittles. It was raining, and Martin was walking with the hood of his sweatshirt pulled over his head. He talked to his girlfriend on a cellphone moments before the shooting, according to Martin’s family’s attorney.

A: On his website, therealgeorgezimmerman.com, Zimmerman has described the shooting as “a life altering event” but he says he can’t go into details about what happened.
“As a result of the incident and subsequent media coverage, I have been forced to leave my home, my school, my employer, my family and ultimately, my entire life,” he said on the site.
Zimmerman has told police that he spotted Martin as he was driving through his neighborhood and called 911 to report a suspicious person.
“This guy looks like he is up to no good. He is on drugs or something,” Zimmerman told the dispatcher from his truck. He added that the teen had his hand in his waistband and was walking around looking at homes.
“These a——-. They always get away,” Zimmerman said on a 911 call.
There had been several break-ins in the community in the past year, including one in which burglars took a TV and laptops.
A dispatcher told Zimmerman he didn’t need to follow Martin after Zimmerman got out of his truck and started following the teen.
Zimmerman told police he lost sight of the teenager and was walking back to his vehicle when he was attacked. He and Martin fought, according to witnesses. Zimmerman said Martin punched him in the nose and slammed his head against the ground.
At some point, Zimmerman pulled a gun and shot Martin. Zimmerman told police he acted in self-defense.
Police said Zimmerman was bleeding from his nose and the back of his head. He told police he had yelled out for help before he shot Martin.
He has not been arrested or charged, but a law enforcement official told The Associated Press on Wednesday that the special prosecutor in the case plans to arrest and charge him. The prosecutor has announced a news conference for 6 p.m. Wednesday, but hasn’t said what information she will release.
Q: WHAT IS THE MARTIN FAMILY’S SIDE OF THE STORY?
A: Much of Martin’s side of the story comes from a cellphone conversation he had with his girlfriend moments before the shooting. She was interviewed by the family’s attorney, Benjamin Crump, and he released much of what she said to the news media. She has not been identified.
In the interview, she said Trayvon Martin told her that he was being followed.
“She says: ‘Run.’ He says, ‘I’m not going to run, I’m just going to walk fast,’” Crump said, quoting the girl.
The girl later heard Martin say, “Why are you following me?” Another man asked, “What are you doing around here?” Crump said.
After Martin encountered Zimmerman, the girl thinks she heard a scuffle “because his voice changes like something interrupted his speech,” Crump said. The phone call ended before the girl heard any gunshots.
Martin’s parents said their son made the pleas for help that witnesses heard.

The decision by Zimmerman’s lawyers to openly question his behavior, and announce that they were no longer representing him unless specifically asked to do otherwise, marked the latest twist in a case that has captured national attention because of race and Florida’s controversial self-defense laws.
The website launched on Monday by Zimmerman, called therealgeorgezimmerman.com, offers one of the first publicly available comments from Zimmerman since he went into hiding after the shooting on February 26.

“You’re not supposed to air attorney-client disputes via press conference,” Tacopina said.

UNDER PRESSURE
**** Sounds like the lawyers threw Zimmerman under the bus for some reason (?) Anything about him or their relationship with him (including lack of contact or mental state) would have been attorney-client privelaged information. But read the whole page. While the Special Prosecutor is filing charges for 2nd Degree Murder (see above about “evincing a depraved mind”) they go on TV and allude to him not being mentally stable under pressure. Of course he is going to be “emotionally crippled by virtue of the pressure of this case” … but this might be something else. Perhaps Zimmerman decided to change attorneys for some reason. Maybe the original attorneys wanted lots of money as a down payment that Zimmerman just didn’t have. He did put up a web site seeking money towards his legal defense.
